EU – Adoption in Sight for the Intra-Corporate Transferee Directive
08 March 2013The EU Council today confirmed plans to conclude negotiations with the European Parliament on the intra-corporate transferees Directive with a view to first reading agreement under the Irish Presidency.
Launched in 2009, the proposed Directive would make it easier for multinational corporations to transfer managers, specialists and graduate trainees temporarily to a branch in the EU. Negotiations between the EU institutions are on going. For first reading agreement to be achieved under the current Presidency, it would need to be adopted by July 2013, when Lithuania takes the helm.
Permits Foundation has already successfully lobbied for two European Parliament amendments that, if agreed by Council, would ensure family members could arrive at the same time as the transferee and work throughout the assignment. The initial proposal by the European Commission did not include these provisions. Over the next few months, Council will decide on whether it can accept the European Parliament amendments.
Inter-institutional agreement on all proposed amendments must be reached before adoption can take place. Member States would then be expected to implement the Directive within three years of adoption.
